By carving transgender minors out of ordinary child-welfare protections in the adoption and foster context, the law singles out a protected characteristic for disadvantaged treatment. Cole McAfee, executive director of Freedom Oklahoma, said HB 3586 "permit[s] what amounts to abusive behavior towards trans+ kids," warning it could place LGBTQ+ foster youth in non-affirming homes and increase their risk of conversion-therapy exposure and suicide.

Equal treatment under law bars the state from structuring child welfare so that a disfavored group's needs are singled out for lesser protection. Oklahoma enacted a law providing that an adoption or foster placement may not be denied or delayed because a prospective parent refuses to support a child's gender transition, and declaring that declining to affirm a transition is not abuse or neglect. By removing child-welfare scrutiny specifically where a transgender minor's identity is at stake, the state disadvantages those children and the parents who would affirm them. Writing a carve-out that isolates transgender youth from ordinary welfare protections is discriminatory state action against a marginalized community.
