ICE detained material witness who helped Houston police identify armed suspect, complicating gun case prosecution

On Sunday, August 9, 2026, an Immigration and Customs Enforcement agent detained a man in the Alief neighborhood of Houston immediately after he called police to report a shooting and helped officers identify and locate the armed suspect, according to Houston police and local news reporting. The man, described in the police report as a laborer, called 911 after seeing another man fire a black pistol into the air in a parking lot outside a Home Depot on Bellaire Boulevard. When officers brought the suspect back to the parking lot for identification, they found the witness who had called them was already being detained by a federal immigration agent; the witness nonetheless identified the suspect to police before the ICE agent took him into custody and left the scene.

Houston police said they did not contact or request assistance from ICE, and that their investigation was not finished when the agent removed the witness. Officers charged the suspect, David Mendez, with unlawful possession of a firearm by a felon. Harris County District Attorney Sean Teare said losing the witness complicates prosecuting that case and described a broader pattern in which cooperating witnesses "effectively go into a black hole" once ICE takes them into custody, citing HPD data showing officers contacted ICE more than 100 times from April through June 2026 after encountering people with immigration warrants during 911 calls, including 34 cases where someone had called for emergency help.

Teare said the incident undermines his office's pledge not to ask crime victims and witnesses about immigration status, and that fear of encounters like this one is already suppressing reports of domestic violence and other serious crimes. The arrest came amid heightened scrutiny of ICE activity in Houston following the July 7, 2026 fatal shooting of Lorenzo Salgado Araujo by an ICE agent, after which a passenger witness was held in ICE custody for weeks before a federal judge ordered his release.
