Utah Gov. Cox signed HB316, requiring jail and prison housing by birth sex and restricting transgender inmate placement

On March 18, 2024, Utah Governor Spencer Cox signed House Bill 0316, "Inmate Assignment Amendments," which bars the Department of Corrections and county jails from housing inmates with others of the opposite biological sex at birth. Sponsored by Rep. Karianne Lisonbee and carried in the Senate by Sen. Heidi Balderree, the law lets a transgender inmate seek gender-matching placement only after a discretionary multi-factor security analysis required of no other inmate. The measure took effect May 1, 2024.

On March 18, 2024, Utah Governor Spencer Cox signed House Bill 0316, "Inmate Assignment Amendments," into law, requiring that inmates be housed in state prisons and county jails according to their biological sex at birth. The measure bars the Department of Corrections or a county jail from assigning an inmate to a living area with inmates of the opposite biological sex, sponsored by Rep. Karianne Lisonbee and carried in the Senate by Sen. Heidi Balderree. It passed the House 58-13 and the Senate 27-0 before reaching the governor's desk, and took effect May 1, 2024.

Under the law, a transgender inmate may request placement matching their gender identity only after a discretionary, multi-factor "individualized security analysis" — weighing anatomy verification, physical characteristics, criminal history, predicted behavior, and staff safety, and including a determination that the inmate is not "claiming" a gender identity solely to change their housing — followed by periodic re-review. No other inmate must clear such a review to be housed by sex. The Department of Corrections must also report annual counts of transgender inmates granted or revoked cross-sex housing. By imposing a separate, more burdensome placement standard on transgender inmates alone, the law singles out a marginalized group held in government custody for treatment applied to no one else.

On April 2, 2024, the U.S. Department of Justice sued the Utah Department of Corrections, alleging it discriminated against a transgender inmate with gender dysphoria in violation of the Americans with Disabilities Act — including failing to provide equal access to hormone therapy and "appropriately assessing her housing requests to avoid discrimination," directly implicating the same discretionary housing-placement review HB316 created. The department dismissed the case on January 29, 2025.

Civil-rights protections bar the government from treating people differently because of a protected characteristic. Utah enacted HB0316, which requires jails and prisons to assign inmates by biological sex at birth and forces transgender inmates alone to pass a discretionary "individualized security analysis" — including anatomy verification and a test of whether they are "claiming" a gender identity — before they may be housed according to their gender identity.
