Utah Gov. Cox signed HB209 mandating statewide birth-certificate collection to enforce K-12 transgender-athlete sports ban

On March 17, 2023, Utah Gov. Spencer Cox signed House Bill 209, the "Participation in Extracurricular Activities Amendments," into law. While the bill's headline provisions eased public-school extracurricular participation for home-school and other nontraditional students, a late provision added by chief sponsor Rep. Jordan Teuscher required every athletic association — including the Utah High School Activities Association — to collect and review a birth certificate or equivalent identifying document from every student athlete as a condition of the association's registration process. The measure amended Utah's education code and defined when a document "does not correspond with the sex designation" for interscholastic eligibility.

Teuscher stated publicly that the birth-certificate mandate was intended to enforce H.B. 11, Utah's 2022 law barring transgender girls from girls' sports, by letting the state check each athlete's birth-certificate sex against the sex designation of the activity. The provision thus created new, statewide-mandatory verification infrastructure that operationalized and expanded enforcement of the existing ban rather than merely easing compliance for other students.

David Spatafore, representing the Utah High School Activities Association, said the association had not agreed to the birth-certificate requirement and warned that the vague language could keep refugee and homeless children from participating in sports. The requirement obliged the association to collect and hold tens of thousands of students' birth certificates.
